Welcome to Agency of the Ozarks. By engaging our services or using our website (www.agencyoftheozarks.com), you agree to the following terms and conditions. Please read them carefully.

1. Overview of Services

Agency of the Ozarks provides digital marketing services including but not limited to:

  • Website development
  • Sales funnel creation
  • Search engine optimization (SEO) & conversion rate optimization (CRO)
  • Paid advertising campaigns
  • Cold outreach strategy
  • Branding & design

All services are custom-built to meet client goals and may include third-party tools, platforms, or plugins.

2. Payments & Billing

Payment terms are outlined in each project proposal or service agreement. In general:

  • A 50% deposit is due upfront for projects unless otherwise agreed.
  • The remaining balance is due upon final delivery, before website launch or campaign activation.
  • Monthly services (e.g., SEO or ad management) are billed on a recurring basis and due in advance.

Late payments may result in service suspension.

3. Refund Policy

Refunds are limited and issued at the sole discretion of Agency of the Ozarks. As our work is service-based and often custom, refunds will not be issued for:

  • Completed design or development work
  • Time-based services already rendered (SEO, ad management, outreach)
  • Client delays or lack of communication

If you believe a refund is warranted, please contact us within 7 days of delivery or project milestone to discuss resolution.

4. Shipping & Delivery Policy

Agency of the Ozarks delivers all services digitally. No physical goods are shipped.

  • Websites and marketing materials are delivered through cloud services (e.g., Notion, Trello, Webflow, Google Drive).
  • Communication and approvals are handled via email, Zoom, or Slack.
  • Typical project delivery timelines range from 3 days to 6 weeks, depending on scope.

Delivery timelines may adjust based on client response times or technical factors beyond our control.

5. Return Policy & Process

Since all services are digital and tailored, there are no returns applicable. However, we offer revision periods to ensure your satisfaction:

  • Website projects: 2 rounds of revisions included.
  • Branding/design: 2 concepts and 2 revisions included.
  • Ad campaigns: Ongoing optimization as part of the service.

Additional revisions beyond those included may incur extra charges.

6. Cancellation Policy

You may cancel ongoing monthly services (e.g., SEO, ads) with 14 days' written notice before the next billing cycle.

Project cancellations after work has begun are subject to the following:

  • If canceled before design/development begins, you may be eligible for a partial refund.
  • If canceled during the project, you’ll be charged for the portion of work completed to date.
  • No refunds will be issued for completed projects.

Agency of the Ozarks reserves the right to cancel or pause services due to non-payment, abusive behavior, or repeated missed deadlines on the client’s part.

7. Client Responsibilities

Clients are expected to:

  • Provide timely access to necessary materials, content, and logins.
  • Respond to communication within a reasonable timeframe (typically 2–3 business days).
  • Approve or request revisions promptly to avoid delays.

Failure to fulfill these responsibilities may delay project delivery or pause services.

8. Ownership & Intellectual Property

Upon final payment:

  • You own the rights to the final website, designs, and marketing assets we create for you.
  • We reserve the right to showcase completed work in our portfolio and marketing materials unless you request otherwise in writing.

Third-party software or platforms (e.g., Webflow, Google Ads) are subject to their own licensing agreements.

9. Limitation of Liability

Agency of the Ozarks is not liable for:

  • Loss of revenue, clients, or reputation due to technical issues, market shifts, or platform bans
  • Delays caused by third-party tools or providers
  • Actions taken by you or your team that affect the performance of our work (e.g., editing code, pausing ads)

We do our best to minimize risks and maximize results, but we do not guarantee specific rankings, traffic, or revenue outcomes.

10. Privacy Policy

Agency of the Ozarks respects your privacy. We collect only the information you provide (such as name, email, and project details) to deliver our services and communicate with you. We do not sell or share your data with third parties, except as needed to operate our business (e.g., using email or website platforms). By using our site or services, you consent to this policy.

11. Dispute Resolution

If a disagreement arises, both parties agree to attempt informal resolution before seeking legal action. If unresolved, disputes shall be handled in accordance with the laws of the State of Missouri.

12. Modifications to Terms

We may update these Terms & Conditions at any time. When we do, we’ll revise the “Last Updated” date at the top. Your continued use of our services after changes are posted constitutes your acceptance.
